Julian Assange Awakens Secrecy as Repugnant to Freedom

This is an article from the Australian ABC regarding Julian Assange, lawyers, breach of privacy and surveillance.  The article focuses on the recording of Geoffrey Robertson QC a famous Australian barrister, well known by those of us over 40 for the ABC program ‘Hypothetical’.  Geoffrey Robertson demonstrated justice as he challenged influential Australians to respond to controversial issues, scenarios indicating how they would handle a difficult problem. He demonstrated Justice and Inquiry. 

He is a human rights lawyer and his lawyer-client privilege was breached due to powerful interests not driven by Justice but power. 

I felt inspired to give J F Kennedy a voice in this blog which drives to the heart of this problem.

When you deeply contemplate the journey of Julian Assange you realise he is a light on the hill as he reminds the US of its true purpose as they have lost their way.  He is a beacon who not only revealed US secrets but awakened the world to what is called the ‘dark side’ of surveillance and political corruption. Justice is not a business deal it is about the truth that sets all free.

Recently I wondered about him. I sent light and protection to him and that he is safe as the US seek to jail him for revealing what is on ‘a need to know basis’

When you have experienced inequality before the law, illegal surveillance, privacy breaches and corruption your Cinderella world view dissolves as you become dis-illusioned.  That is, the illusion falls from your eyes and you see clearly.

2020 (vision) is about clear seeing.

Until you walk in Julian’s shoes you cannot know the sacrifice he made in the public interest, albeit global interest. We are learning about how power operates as distinct to Justice. The lengths people will go to, to win and pervert the course of  justice. The lack of ethics, integrity and use of manipulation of the rule of law is under the spotlight. 

It is noteworthy that those persons exposed crimes and/or breaches to the Constitution are not arrested but the whistle-blowers are pursued as if criminals and rights to Justice undermined.

The Brave New World is a teacher, we are being given glimpses into this possible future and every person is choosing. This is the real universal vote. Complacency (compliance) or democracy?

The surveillance state is increasingly being privatised as contractors are paid by national intelligence agencies accessing secrets themselves.  Secrets (security) are leverage.  Imagine how wide spread is espionage as intelligence becomes private security (business) becomes intelligence in the revolving door of greed where there is always a back door to breach privacy and make money from vulnerability.  Greed is the key issue arising out of a desire to live like the US, yet, must we rob Peter to pay Paul. Debt is another leverage point.

“I wasn’t surprised at all. It’s an occupational hazard for human rights lawyers. You’re bugged, you’re followed by secret police, you’re spied upon,” said Robertson, one of Australia and the UK’s most respected human rights barristers for almost 50 years.

The extradition hearing comes amid a flurry of activity related to Assange: on Friday his legal team also confirmed they will try to seek asylum for the WikiLeaks boss in France, and on Thursday an English court heard that Assange was offered a US presidential pardon if he agreed to say that Russia was not involved in a 2016 leak of Democratic Party emails.

When the ABC asked questions of the US embassy in Canberra, it referred questions to the US justice department, which did not respond by deadline.

The ABC also sent questions to the CIA and the US Office of the Director of National Intelligence. Neither responded by deadline.

It’s just after 7:00pm on January 12, 2018.

The camera rolls as Robertson stops at the front door, unbuttons his overcoat and removes his cap.

Once inside the embassy, other cameras follow him as he’s ushered into a meeting room, where the storied Queen’s Counsel is offered a cup of tea.

After a few minutes, he is greeted by the embassy’s most famous resident, Julian Assange.

The camera continues to roll, recording every word of the confidential legal conversation which follows.

While this may be typical surveillance at a secure diplomatic property, what Robertson did not know was he and a handful of other lawyers, were allegedly being targeted in a remarkable and deeply illegal surveillance operation possibly run at the request of the US Government.

And recordings such as Robertson’s visit are at the heart of concerns about the surveillance: privileged legal conversations between lawyer and client in a diplomatic residence were recorded and, later, accessed from IP addresses in the United States and Ecuador.

Robertson was only one of at least three Australian lawyers and more than two dozen other legal advisers from around the world that were caught up in the surveillance operation.

Long-time WikiLeaks adviser Jennifer Robinson was one of the other Australian lawyers caught in the spying operation.

On Monday evening (Sydney time), Assange will face an extradition hearing relating to US criminal charges against him for his role in the WikiLeaks releases of classified US Government material.

The extradition hearing comes amid a flurry of activity related to Assange: on Friday his legal team also confirmed they will try to seek asylum for the WikiLeaks boss in France, and on Thursday an English court heard that Assange was offered a US presidential pardon if he agreed to say that Russia was not involved in a 2016 leak of Democratic Party emails.

The offer of a pardon was allegedly made by the US congressman Dana Rohrabacher when he visited Assange in the embassy in August 2017. Rohrabacher has denied he was making the offer on behalf of Donald Trump.

‘It’s an occupational hazard for human rights lawyers’

The surveillance was uncovered via a very public investigation into the Spanish company contracted by the Ecuadorian Government to provide security at the embassy, UC Global.

WikiLeaks Spanish lawyer, Aitor Martinez, told the ABC the surveillance came to light after Assange was arrested, when former UC Global employees provided a large file of material.

“This consisted of recordings from cameras installed in the embassy and hidden microphones; recordings made with secret microphones placed inside the embassy; hundreds of secret copies of the passports of Mr Assange’s visitors; multiple emails exchanged between the company owner and the employees,” Martinez said.

The recording of lawyers and legal conversations was not accidental, according to the Spanish criminal case, which is now investigating UC Global and its owner, former Spanish Navy marine David Morales.

“David Morales was justifying himself by saying that he had been expressly asked for this information, sometimes referring to ‘the Americans’,” a UC Global employee turned prosecution witness said.

“He sent on several occasions — via email, by phone and verbally — some lists of targets in which we had to pay special attention … they were mainly Mr Assange’s lawyers.”

“I wasn’t surprised at all. It’s an occupational hazard for human rights lawyers. You’re bugged, you’re followed by secret police, you’re spied upon,” said Robertson, one of Australia and the UK’s most respected human rights barristers for almost 50 years.

Robinson — also an Australian citizen — was spied on while providing confidential legal advice to Assange.

“It is incredibly troubling that our secret and privileged legal conversations with Julian Assange were recorded and apparently handed to US authorities,” she told the ABC.

“It is one of the most fundamental principles of protecting attorney-client relationships that we are able to have confidential and private meetings, to discuss legal strategy.”

The concerns about illegal monitoring of confidential legal discussions may become part of his defence, with his lawyers expected to argue that the espionage has denied Assange his basic legal rights.

Foreign Minister Marise Payne did not respond to ABC questions about the Spanish case. The Department of Foreign Affairs (DFAT) also declined to discuss it, only noting that it had previously sought assurances that Assange would be treated appropriately under UK law.

“The Australian Government cannot intervene in any extradition request for Mr Assange, which is a matter for the UK authorities,” a DFAT spokeswoman said.

Robinson said that she believed Canberra had not done enough to protect Assange, an Australian citizen.

“This is a case in which an Australian citizen is facing 175 years in prison in the United States for the same publication for which he won a Sydney Peace Prize and the Walkley award for the most outstanding contribution to journalism,” she said, referring to WikiLeaks’ publication in 2010 and 2011 of confidential US documents that revealed, among other things, war crimes and illegal spying on world leaders.

“His Australian lawyers — all of us Australian citizens — have [also] had our rights as lawyers and our ability to give him a proper defence superseded by the US and potentially the UK Government.

“This is something that the Australian Government ought to be taking very seriously and ought to be raising both with the UK and with the United States. It is time the Australian Government stands up for this Australian citizen and stops his extradition.”

The file

The ABC has obtained hundreds of internal UC Global documents, videos, audio files and photos tendered in the Spanish case, which commenced in April last year days after Spanish newspaper El Pais published videos and audio of Assange and guests being spied on in the embassy.

The files reveal the remarkable and expanding secret surveillance targeting the WikiLeaks boss and his guests.

In an email from September 2017, Morales ordered UC Global staff to find out what the walls around Assange’s bedroom were made of, and to photograph the embassy’s rooms and its furniture.

Then in December, UC Global updated the embassy’s camera system, installing audio-capable cameras.

A month later, and under instructions from Morales, they installed a listening device in the false base of the meeting room’s fire extinguisher.

They also installed a microphone in the women’s bathroom — a place where Assange would regularly hold sensitive legal meetings.

The case is being investigated by Spain’s federal court, the Audencia Nacional, which is examining whether Morales and UC Global are guilty of breaching both Assange’s privacy and lawyer-client privilege, as well as crimes relating to misappropriation of funds, bribery, and money laundering.

“From 2015 to mid-2018, when UC Global lost the embassy’s security contract, a battery of illegal espionage measures was deployed, with massive interference in the privacy of [Assange], in his communications with his [legal] team, in meetings with his doctors, and in general against everyone close to him,” a criminal complaint filed by Assange’s Spanish lawyers stated.

“In those years the defendants created a sort of ‘Big Brother’ in which all the movements of Mr Assange and the people close to him were monitored.”

The case commenced after a group of Spanish citizens contacted senior WikiLeaks employees and demanded a significant sum of money in return for what they said was voluminous proof of the espionage.

A former UC Global employee — who cannot be identified for legal reasons — also separately approached WikiLeaks, wanting to reveal what they saw as the illegal behaviour of their former company.

WikiLeaks referred the case to Spanish courts, who launched an investigation and arrested Morales. He was later released on bail.

“This spying did not only affect Mr Assange’s lawyers, it also affected all of his visitors, including journalists,” Martinez said.

“It got to the point where, during a visit to Mr Assange, the head of Ecuador’s intelligence service [Rommy Vallejo, on December 21, 2017] was also spied on,” Martinez added.

“In the meeting between Mr Vallejo and Mr Assange the possible release [from the embassy] of Mr Assange in a few days later was discussed.”

Within hours of that secret meeting, which was known to only a few people, the US Ambassador to Ecuador complained to Ecuadorian authorities, and the next day the US issued an international arrest warrant for Assange, Martinez said.

“That leads us to believe that the conversation was urgently sent to the US authorities and that they urgently issued the international arrest warrant the next day,” he said.

Martinez was himself spied on while having legal meetings with Assange at the embassy.

“Mr Assange began to suspect that he was being spied upon … so he asked us to hold the most sensitive meetings in the women’s toilet at the back of the building,” Martinez recalled.

“We honestly thought it was an exaggerated step to hold our legal meetings in the women’s toilet, where he would even open the water tap to avoid anyone listening.

“It was interesting to find out that Mr Assange was, in fact, correct: the material before the court proves that UC Global knew the meetings were held inside the women’s toilet, as they proceeded to install an additional microphone [there].”

‘It goes to the heart of client-lawyer privilege’

While the case made headlines in Europe and the UK, there has been little to no discussion here about what it means for the Australian citizens and lawyers caught up in the alleged espionage operation.

The Law Council of Australia told the ABC the alleged surveillance operation was “deeply disturbing”.

“The allegations that Julian Assange’s conversations with his lawyer were being recorded are really serious,” the council’s president, Pauline Wright said.

“If you can’t have that full, frank discussion without fear that that’s being recorded and potentially released to the authorities … it erodes trust in the whole system.

“It goes to the heart of the client lawyer privilege.”

The file also reveals that Morales’ surveillance project — dubbed Operation Hotel — did not just observe Assange and his guests. Internal UC Global documents reveal staff also stole or illicitly photographed visitors’ belongings.

The file includes photos of passports, mobile phones, computers and other electronic devices owned by dozens of activists, journalists, lawyers and public figures that visited Assange.

The file also reveals a growing desire, on Morales’ part, for ubiquitous surveillance of Assange and his visitors.

Morales directed UC Global to scrutinise particular people visiting Assange, whom he refers to as “el huesped” (the guest).

“We must … create or improve the following profiles (personal data, relationship with the guest, phones, emails, number of visits, et cetera) of these regular visitors or collaborators of the guest,” he said.

He lists nine people, one of whom is Robinson.

“We must do everything to know their data … I want a person completely dedicated to this work, so if you have to hire someone for it, tell me,” Morales said.

“All this must be considered top secret.”

UC Global staff sometimes resisted their boss’s more intrusive requests. In December 2017, Morales allegedly directed an employee to steal the used nappy of a baby who sometimes accompanied his mother when she visited Assange.

The theft was necessary, Morales said, to DNA test faecal matter to establish if the child was Assange’s son.

“I decided to talk to the mother of the child,” the employee said in his statement to the court.

“When we were outside of the embassy, I told her that she must not take the child to the embassy anymore because they planned to steal her baby’s diapers to prove whether he was the son of Julian Assange.”

‘Amigos americanos’

The Spanish criminal complaint states the turbo-charged surveillance operation began after Morales travelled to Las Vegas in 2015 for a security fair. There, he signed a contract with Las Vegas Sands, a company owned by billionaire Trump donor Sheldon Adelson, according to the complaint.

Ostensibly, the contract was to provide security services to Adelson on his mega yacht, the Queen Miri.

But, when Morales returned to Spain, he told UC Global staff they were now “playing in first division”, according to two witness statements tendered in the case.

“[Morales] said he’d gone to the ‘dark side’, referring to himself as a casual collaborator with US authorities, and he said that as a result of this collaboration, ‘The Americans will get us contracts all over the world’,” one witness said in his statement.

Throughout the operation, the employees were repeatedly told by Morales that the surveillance operation was being directed by people he referred to as “amigos Americanos” (American friends).

Concerned about the increasingly illegal behaviour, the UC Global associate pressed Morales on the euphemistic references to “Americans”, demanding to know exactly who they were working for.

According to the statement, Morales replied: “la inteligencia de Estados Unidos” (United States intelligence).

“However, when I asked him who was the particular intelligence person he was meeting to provide them information, Mr Morales ended the conversation and told me that this topic was handled exclusively by him outside the company,” the UC Global associate told prosecutors.

The associate told the court he had repeated and heated discussions with Morales about the operation and who was behind it.

Once such conversation ended with Morales making the gesture of opening his shirt and saying: “I’m a mercenary!”

US action

At first, Morales collected the surveillance footage and delivered it by hand to unknown people in the US.

Later, he asked staff to create a file server and then a secret website to stream the embassy cameras.

A UC Global employee responsible for running the secret website told the Spanish court he noted at least one visitor to the site with an American IP address.

In a Spanish interview, Morales said neither he nor UC Global staff installed any listening devices in the embassy and suggested WikiLeaks had placed the microphones around the embassy.

When the ABC asked questions of the US embassy in Canberra, it referred questions to the US justice department, which did not respond by deadline.

The ABC also sent questions to the CIA and the US Office of the Director of National Intelligence. Neither responded by deadline.

Australia’s St Elmo’s Fire is a Test

This poem came from inspiration about the Australian bushfires and homelessness.

The poem I felt inspired to write reveals the importance of fires in nature to clear the old to make way for renewable growth within us.

The poem rekindles the Australian spirit of who we really are when in crisis. The real phoenix is our rebuilding who we are as a nation.

Australia’s St Elmo’s Fire is the Test

 

The burning bush,

Is not a winter burn off,

It is not seasonal regeneration,

But a towering inferno of epic proportion,

Smoke billowing blanking out the blue sky,

As communities are under siege,

Seeking to defend property,

Unaware our right to property is the real fire storm,

So help me God!

 

A climate of change in government is not responsive to the real ecological crisis,

A climate of change in business is not responsive to sustainability as they aim for more growth with less,

Yet it is market based economics that is the red hot ember that won’t go out of season,

Cutting public services as under growth is neglected,

For they cannot see the forests for the wood,

Nature is a raw material costed for production not a natural wonder maintaining ecological function,

People are human resources costed per hour
not human beings growing up to empower,

Seen through the googles of economics
life is an algorithm not a rubrics cube,

The yoke of debt is not an Act of God but unaffordable rent,

The wild fires have become a fire sale,

Destroying 8.4 million of hectares in the blaze will increase market prices,

A billion animals perished in the smoke haze,

Impacting the biomass as prayers were not answered,

Homeless people camping in the bush were razed
gained no relief or went missing without alarm,

Renters were given no grants or land,

As property owners are hard working and deserving,

Government, media and business jumped on the bandwagon not on the fire truck,

Circling the wagons is not containment of disruption,

Opportunities to strengthen brand images rather than imagine no brands to ask for change not coins,

Still seeking a bounty from the mutiny,

The mutiny on the bounty is to leave GDP,

As branded cattle are piled on burial mounds,

Agricultural crops and harvesters went up in smoke,

Timbers become cinders,

Run for your life abandon possessions, beloved memories and pets,

This is the test,

To save lives not things,

To remember each other and lend an equal hand,

For this is the meaning of the aussie battler,

Bush community know common unity,

As they battle fires with families and friends.

 

Giving is to be good as gold,

Yet what if the gold is in being truly good,

You would naturally give time and all you have,

For it is human nature to give not take away,

To pitch in or risk losing all,

As livelihood is to live your life to be really alive,

This is St Elmo’s fire testing your determination and stamina,

From smouldering embers spark new shoots to push up breaking new ground,

From hardship comes rebirth of a renewable life,

From pot ash comes the phoenix resurrecting renewal,

And all can rise when you can go down no further,

For the rural farmers have suffered for years,

They lost their voice,

Mortgages as debt was the tourniquet squeezing livelihoods year on year as hard work doesn’t yield.

 

Many have been weighed down…

By what is not important in fears,

By material things that no longer bring joy,

By worries about money that never end contracts,

By conflicts from stress and out of touch bureaucracy,

By family breakdown under pressure,

By rising costs and uncertain futures,

They have been the backbone of our country.

 

Yet what if you look up to the stars my friend?

Take your hands from your eyes to see beyond,

That a new day dawns every day,

The sun-rises from the east setting in the west,

To know that from bad seeds come good,

From disruption comes clarity of purpose,

For you can’t get back what is a final demand,

When one door closes another opens,

And the finale of life is to let go when it is done and dusted,

To face fires, flood, famine and drought fearlessly
as dawn, midday and dusk mark time,

For we must face the phases of the moon together,

We must give a hand up and a hand out
no matter who is in need,

As he drove cattle down mountain views where all hesitated to step off the real cliff hanger,

Courage leads whilst fear weighs the risks,

In the high country the brumby’s sniff the wind adapting to climates of change as they know which way to run.

Australians know the struggle and the peaks,

As we are heading for a depression of great magnitude,

An economic earthquake shaking ‘em up,

The Great Barrier Reef sacrificed corals to pollution favouring a crown of thorns,

The Great Artesian basin is sinking the water table as hard water is diverted and dries up,

Salt lakes muddy clean waters,

Fertilising biosciences grow at ever diminishing returns akin anti-bio-tics,

Nature is not an electrical circuit board or linear cog in an industrial flywheel,

It is a tipping point of infinitesimal sensitivity,

Where the sum of the parts is the whole.

Descartes reduced life to boxes not cells,

Newton gravitated to apples not seeds,

Einstein’s relativity theory was not absolute,

Mythical dragons breathe fire yet oxygen is fuel,

Oxford became lost in space seeking the last frontier,

Dances with Wolves chose to go to the frontier country before it was lost,

Buffalos were killed for skins not hunger,

Science invented wars losing the peace prize,

For the real courage is to face what we have truly lost and not hesitate to act,

We are lost in space unable to make peace

A priority,

For until we do we hesitate on the mountain view unable to step off the cliff of uncertainty,

As life is not predictable nor mechanical,

It is a miracle,

And only when you lose everything do you realise the true value of life,

For this is the real gold,

Or indeed the Fool’s Gold of awakening from the dream,

Fires cleanse away debris to make way for renewable growth,

As life is the real wealth loving,

And until you taste the sweetness
greed will be the bad seed replanted,

Yielding endless wars fuelling climates of disruptive change,

For until the burning bush is seen as a message from the creator,

Heralding that all people are chosen,

And that all roads lead home,

For Rome will return to the Garden of Eden,

Adam & Eve will plant an apple tree together,

Receiving nature’s bounty at the perfect time in peace,

Loving what is was all ways the peace that passeth all understanding.

Home is to Sing the One Song


It is Christmas Time,

Everyone is rushing around,

Finishing up work for yet another year,

Presents, food, visitors, trees and decorations,

Celebrations as the community looks forward to time off to relax,

To try to just be

happy.

 

Homelessness has no time off,

For you cannot afford a holiday,

You cannot buy presents or cook a Christmas lunch,

You cannot go out with friends,

As the ends has to find the means,

You cannot drive in the country and forget about life,

For there is no summer break as homelessness is full time,

Many reach real natural limits,

As they cannot join in when excluded,

As they cannot come out in shame,

As life is survival not celebration,

For a personal crisis can become a rubrics cube,

Where you just can’t find the winning combination,

Stuck in the labyrinth with no way out,

As each alley appears blind,

Yet when someone is kind,

A new door opens,

To faith.

 

Many do not relate to homelessness as they have a home,

Many do not relate to hunger as they can buy something to eat,

Many do not relate to not affording public transport as they have a car,

Many do not relate to not affording a phone as they just renew their credit,

Many do not relate to credit running out, the well spring running dry or food insecurity,

Nor losing friends or family as they have many reunions.

 

For those without a place called home,

A place where they belong,

They have to be strong,

To find home is where the heart is,

For this is the swan song staying afloat,

This is the unchained melody seeking freedom,

That reminds us that we can ‘be the change we wish to see’,

For to be free is to see opportunity,

Even in blind alleys with no exit,

Even in silent exclusion when locked out in the cold,

Even in indifference walking past real need,

For the future will walk in hope and inspiration as the renewable seed,

The future will turn hard knocks into wisdom of the elders,

The future will awaken as we are our sisters and brothers keepers,

Keeping a watch on each other’s well-being for the common good.

To know: 

What you do for another returns to the self,

For it is not to disable but enable inclusion,

It is not to make dependent but to empower independence,

It is not tomorrow for NOW is the hour of our decision,

To remember we are ONE family not living on isolated islands of despair,

That we are singing the ONE song at a higher frequency.


To inspire that:

We all belong when we let go of fear and judgement,

We all belong when we let go of inequality,

We become strong when we let go of anger,

When we forgive as this is for giving,

And to give is to receive,

To receive is to know,

That what you give returns in abundance,

That we have the inner wealth to keep on giving,

That we receive a smile,

We give a kind word,

That we receive a truthful response,

That we give random acts of kindness,

As strangers can come to us without warning to remind us,

That love is all around,

That love is who we are,

That love never is left wanting,

That we are loved without condition,

For this is unconditional love,

Which is the greatest petition giving all of our heart 
to all without fear or favour,

To learn unconditional love as the real test of our lives,

For our lives are always tested when we confront our greatest fears,

When we are about to leap off into a great adventure,

The tragedy and/or the comedy arrives,

For it is to face life with courage,

It is to laugh at life with humour,

It is to find the wisdom in life as it hands you a piece of bread,

Will you break bread or hide it away under a bushel?

To see the perfection in the process,

For there are no mistakes in the universe,

And the uni-verse is again, the one SONG,

The verse is the rhythm and the rhyme,

That reminds us yet again …

that all BELONG in this SONG.

 

You are unique and a treasure,

For your gift to life is your very self,

And you are the pre-sent,

The present at Christmas,

A gift that has been given and received,

Without expectation of return or to earn respect,

For happiness is the greatest gift I can give everyone,

Love is the greatest inclusion I can offer in humility,

Peace is the greatest example I can live as our destiny,

No matter outer conditions,

For I am learning that every day is Christmas,

That Christ mass consciousness is in the masses no matter religion,

For the real petition is to love your neighbour as yourself without condition,

For Love was always the answer.

 

Did you know the perennial question?   How can I love my life?

Love until it no longer hurts,

For love is to re-member each other as true selves,

Perhaps these are the elves at the bottom of the garden?

A Garden of Eden is harmony expressing the perfect presence,

For to extend the hand of friendship as a real friend 
is to truly see you are me,

And what I do to another returns to the self.

So when one feels homeless,

Or less without a home,

Show them the home in your heart as an opening flower positively shining,

As kindness matters.

 

When someone reaches out to you in hope,

Reach back with real inspiration,

As REAL HOPE inspires what matters.

When someone has no money,

Offer abundance in a way that feels ‘good’,

For the real wealth is sharing,

Real sharing is caring,

Real caring is smiling,

For to C.A.R.E. is Courage, Awareness, Respect and Equality,

For this is the inclusion that has no limit,

Acceptance is the greatest gift you can give at Christmas,

Happiness is open to presence re-membering who we really are,

For how can one not shine when a member of the human family,

 

Realising –

HOME is where the heart is,

And the heart always remembers

HOME.

Clooney: The Powerful Must be Held to Account

 In the public interest.  I have my concerns about Microsoft. If we are to talk about accountability and justice, then companies must also look at their violations of privacy, their behaviour and conduct and their activities that move us away from democracy towards compliance doctrines.

Human Rights Institute and Clooney Foundation for Justice Train Observers to Monitor Trials Where Human Rights May Be at Risk

Human Rights Clinic students working with TrialWatch have begun monitoring legal proceedings to help safeguard rights of journalists, dissidents, and LGBTQ individuals.

Beatrice Moritz / Clooney Foundation for Justice Columbia Law announced in December that it would partner with the Clooney Foundation for Justice (CFJ) and the American Bar Association (ABA) to develop TrialWatch.

Columbia Law School’s Human Rights Institute and the Clooney Foundation for Justice formally launched the TrialWatch program with a day-long conference at the Law School featuring human rights advocates, academics, journalists, and lawyers urging action to protect free speech and guarantee fair trials internationally. TrialWatch will train and send monitors to observe legal proceedings in nations where human rights may be at risk, develop “fairness reports,” and if necessary, assist defendants in pursuing remedies in human rights courts. Monitors will observe trials involving journalists, LGBTQ persons, women and girls, religious minorities, and human rights defenders.

“Without the fair administration of justice, it is not possible to hold the powerful to account. There can be no democracy, no freedom of speech, no safety for minorities,” said Amal Clooney, foundation co-president and a senior fellow at the Human Rights Institute.

“We measure corruption by governments, but not by courts. We monitor the fairness of elections, but not trials. Leaders accused of holding political prisoners can get away all too easily with bare denials and stock answers about the separation of powers. We need extensive monitoring, hard data, and committed advocacy if this is to change.”

Clooney and co-president George Clooney spoke at the April 25 launch event hosted by the Law School along with Dean Gillian Lester, the Lucy G. Moses Professor of Law; Columbia University President Lee C. Bollinger ’71; Microsoft President Brad Smith ’84; former United Nations High Commissioner for Human Rights Zeid Ra’ad al-Hussein; and American Bar Association President Bob Carlson.

Their panel discussion was moderated by New York Times op-ed columnist Nicholas Kristof. Clooney Foundation for Justice Co-presidents Amal and George Clooney.

A Microsoft-funded TrialWatch Legal Fellow, Sarah Mehta, is implementing the program and working with students in the Human Rights Clinic to train them in trial observation. The program has already sent Human Rights Clinic students Nicole O’Donnell ’19, Andie Reyes ’20, and Sophie Tarazi ’19 to monitor trials in Zambia and Turkey. “Columbia has a long and influential history in shaping international human rights law and institutions,” Dean Lester said, citing the Human Rights Institute and its work to advance research and best practices around trial monitoring as it relates to international human rights law and advocacy.

TrialWatch “is a logical extension of Columbia’s commitment to human rights. It represents a novel innovation that has the potential, through technology and global cooperation, to ensure the fair administration of justice and the dismantling of corrupt systems of governance around the world,” Lester said. “These are principles for which Columbia Law School has advocated since before the passage of the [1948] Declaration of Human Rights, and we are so pleased to continue to advance those ideals through TrialWatch today.”

The Fool’s Journey Home to Peace

I felt inspired to write this today.  What we fear we create.  When we own it we change the outcome and indeed the future for children.

Before reading the poem below here are two trailers that connect to it.  The first is Hackshaw Ridge, the US soldier who saved lives rather than ending them. He asked god ‘one more…’ Every life is precious.  The second is a scene out of Star Wars when Luke sees himself in Darth Vader. There is great wisdom in films when you are open to truth.

The poem is to awaken the force as those seen as the Fool discovers the journey home. Truth is the pathway. Whistle-blowers are the way showers.

THE FOOLS JOURNEY HOME TO PEACE

I sit in a café feeling inspired,

The fire of my inquiry licks at the wood that is called the forest,

For we only see the wood for the trees,

We cannot see nature and its intimate wisdom that stands still,

For all to see,

But many do not hear the whisper on the winds of time,

That we must change or fall,

For how can one hear a tree fall in the forest if we no longer exist.

I find my road is off the beaten track,

I have taken the side road,

Albeit a track less travelled,

For I must find my way through the jungle alone,

For the dark night of the soul was confronting all fear,

40 days in the desert was to confront the rings of fear,

For there are many rings causing fear in this world

Of confusion.

I feel I have journeyed for many lifetimes in the ONE,

I have stood in many shoes feeling their feelings,

For humanity is where we are the same same but different,

Dictatorship demands those different be the same and not different,

And these are the polarities of climate change anchoring to determine a new direction,

The trick is to sense which way the wind blows in this play,

It can blow hot then cold or cold then hot as if a fever,

For our world is out of balance as it searches to recalibrate homeostasis,

For nature is the final arbiter in this argument that was an opportunity,

For disruption can be an opportunity to see oneself, to jump the track, to become uncomfortable as the rhythm of routine is disrupted,

As events are orchestrated by a conductor or some may say, a wizard,

For he seeks an endless yellow brick road believing gold is of value,

For in the end he will cash in the chips to discover he was fooled by the gold,

For all that glitters is not gold some may say,

To be good as gold is what glitters sparkles in an amplified light,

To know thyself is the Fool’s Gold,

It is the wisdom of the Fool that invites you to play,

To have a say for you are the creator of reality,

And the world turns up in this image,

What image are you creating? 

A world of terror, insecurity and threat for your children?

Or a world of security, infinite possibility and sustainability for all children?

As the universe is your voting booth,

It cannot be rigged or interfered with as real outcomes arise from intention,

What you intend will manifest if you believe and then see,

For watching t.v. manifests an alternate reality that you see then believe,

And this is the mirror of opposites,

It is the distorted mirror exaggerating, elongating, minimising who you think you are,

For when you look in the mirror to see you

only you can know you.

The Jester wears the diamonds as a chessboard as we all make moves,

We all contrast, differ, argue and fight as we seek the light of understanding to lead us out of confusion,

So re-member: It is not to avoid the fight but to stand out in the crowd to find the middle ground,

For at the centrepoint you will find room for all views as 360 degrees frees the mason,

For the Philosophers stone is not chiselled but shape changed by truth,

Purity can not emerge from cultures of abuse called defence changing rules of engagement,

To engage in the truth means to look at you as there is no enemy but unquestioned thoughts believed as true,

For the truth will never advocate abuse, incarceration, torture or extra judicial killings,

Hacksaw is not to remove the leg but to remember true faith that one is not in control,

For those experiencing the soul as less believe in full spectrum dominance and excess,

As greed is the addiction unquestioned,

Business-as-usual refuses to break containment of the slave trade,

As slavery in all its forms can be called freedom yet free dominion is free will,

And we are all given free will whether punished or not,

Human nature is free to love or not,

Human experience is free to fight wars or find peace,

For we must travel our journey through who we are not (psalm 23) to find the enlightenment of who we are,

And all take this journey whether they fight God or not,

For when you fight it always hurts,

When you love it expands the play,

For to play with life is to find your life purpose has meaning,

For this is a meaningfull life when you see to look into your world book.

My story book is a Fool for Peace,

It can be read with suspicion,

It can be read with intelligence,

It can be read with intrigue or mystery,

It can be read top to bottom or bottom to top,

Perhaps sampled by topic of interest or deleted,

As you choose,

For I am you,

You are me,

And each must play a part,

In creating eternity.

For this is the infinity symbol,

Of Omni,

It is a sign wave,

When we focus it becomes a particle no longer in theory,

What you think about you bring about (Universal Law of Attraction),

What you resists persists and what you look at disappears (see through illusion),

As the truth sets you free to see past resistance perfectly,

For to fight against always invites in,

This is the Yin and Yang of war and peace,

To focus on what you want determines happiness or continued drama,

As choice is a vote,

A vote determines if the boat floats or the Titanic sinks,

The think tank reveals addiction to materialism and the fear of not enough as the core problem,

Yet your happy destiny is unavoidable when you believe and then see,

So what you believe will enslave you or set you free,

To see there are no masters and no servants only possibilities…

To be or not to be

free!

As this was always the quintessential Question of Philosophers,

Turning water into wine as an elixir to shape change the Philosophers stone masons on Temple Mount into free masons discovering the truth is unconditional love,

As the gentle dove of peace frees a divided Jerusalem, frees the City of London from magic circles (rings) and frees the Vatican to unite as Adam (atom) is Eve (beginning) touching Creation in reunification to find true love in equality,

For 3:3:3 is trinity, triune and three fold flame of completion of the Fool’s Journey,

For you can only be the Fool when you be true to yourself,

As the self made whole is diversity in unity,

As we are meant to be same same but different.

Life is the mirror not the mask,

The Fool wears the mask to pull off the mask of false faces to reveal,

Luke Skywalker is Darth Vader when he fights against himself
he becomes divided and unconscious within,

When he awakens the soul-force denial fades and he reveals the terror-ist within,

For Galactic peace dawns in the realisation that there is ‘no other’,

And in the end the last decision is to love ‘all that is’,

For the dove is waiting on your welcome …home,

To this veritable sustainable

Garden of Eden.
